Estate Agents are prohibited from carrying out any estate agency work by the Estate Agents Act 1979 when an undischarged bankrupt, except when they are employed by another person. Estate Agents who enter into an IVA are not exposed to such a sanction.
If an Estate Agent enters into an IVA or is declared bankrupt then this will result in mandatory exclusion from the National Association of Estate Agents. Readmission is a possibility, but unlikely, although registration is not required to operate as an Estate Agent.
Architects and Surveyors who are declared bankrupt are dealt with differently by the Architects Registration Board, which has a discretionary approach on a case-by-case basis in accordance with current guidelines.
