Following the repeal of the Financial Services Act 1986 and subsequent enactment of the Financial Services and Markets Act 2000, the responsibilities and functions of the Self Regulatory Organisations were transferred to the Financial Services Authority (FSA).

As a consequence, the FSA has the right to participate in proceedings relating to issues such as bankruptcy orders and individual voluntary arrangements (IVAs). The Financial Services and Markets Act 2000 provides that a prohibition order, (which would prevent an individual from performing specified functions) may be made "if it appears to the (FSA) that an individual is not a fit and proper person to perform functions in relation to a regulated activity carried on by an authorised person".
